You may not send automated queries to EonSex without without express permission in advance from EonFactory.  If you want to make commercial use of Eonsex's services, you must enter into an agreement with EonFactory to do so in advance.   
 

The sites displayed as search results or linked to by Eonsex are developed by people over whom EonFactory exercises no control. The search results and keywords are indexed by Eonsex's automated machinery and computers, and EonFactory cannot and does not screen the sites before including them in the indices from which such automated search results are gathered. Searches using Eonsex may produce search results and links to sites that some people find objectionable, inappropriate, or offensive. EonFactory cannot guarantee that a search on EonSex will not locate unintended or objectionable content and EonFactory assumes no responsibility for the content of any site included in any search results or otherwise linked to by EonSex. 
 

If you find images on EonSex that might be deemed universally objectionable, click the "Illegal Content" link in the frame or send us the URL of the page, date, the query leading to the gallery, and the number of the result.

UNDER NO CIRCUMSTANCES SHALL EONFACTORY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF EONFACTORY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM ANY ASPECT OF YOUR USE OF EONSEX, WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF EONSEX, FROM INABILITY TO USE EONSEX, OR THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF EONSEX. SUCH LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH EONSEX OR ANY LINKS ON EONSEX, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH EONSEX OR ANY LINKS ON EONSEX. NO ACTION, REGARDLESS OF FORM, ARISING OUT OF THE USE OF EONSEX OR UNDER THESE TERMS OF USE MAY BE BROUGHT BY YOU MORE THAN ONE YEAR AFTER THE EVENT WHICH GAVE RISE TO THE CAUSE OF ACTION OCCURRED. 
 

WITHOUT LIMITING THE FOREGOING, UNDER NO CIRCUMSTANCES SHALL EONFACTORY BE HELD LIABLE FOR ANY DELAY OR FAILURE IN PERFORMANCE RESULTING DIRECTLY OR INDIRECTLY FROM ACTS OF NATURE, FORCES, OR CAUSES BEYOND ITS REASONABLE CONTROL, INCLUDING, WITHOUT LIMITATION, INTERNET FAILURES, COMPUTER EQUIPMENT FAILURES, TELECOMMUNICATION EQUIPMENT FAILURES, OTHER EQUIPMENT FAILURES, ELECTRICAL POWER FAILURES, STRIKES, LABOR DISPUTES, RIOUTS, INSURRECTIONS, CIVIL DISTURBANCES, SEXUAL DISORDERS, SHORTAGES OF LABOR OR MATERIALS, FIRES, FLOODS, STORMS, EXPLOSIONS, ACTS OF GOD, WAR, GOVERNMENTAL ACTIONS, ORDERS OF DOMESTIC OR FOREIGN COURTS OR TRIBUNALS, NON-PERFORMANCE OF THIRD PARTIES, OR LOSS OF OR FLUCTUATIONS IN HEAT, LIGHT, OR AIR CONDITIONING. 
 

YOU SPECIFICALLY ACKNOWLEDGE THAT EONFACTORY SHALL NOT BE RESPONSIBLE FOR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY, AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU. 
 

Requests for removal of links or thumbnails 
EonSex may occasionally receives requests from people to remove links or thumbnails from its indices. Although EonFactory reserves the right to address such requests individually, the general approach that EonFactory takes reflects the following principles: 
 

Eonsex's indices consist of information that has been identified, indexed and compiled through an automated process with no advance review by human beings. Given the enormous volume of web site information added, deleted, and changed on a frequent basis, EonSex cannot and does not screen anything made available through its indices. For each web site reflected in Eonsex's indices, if either (i) a site owner restricts access to his or her web site or (ii) a site is taken down from the web, then, upon receipt of a request by the site owner or a third party in the second instance, EonSex would consider on a case-by-case basis requests to remove the link to that site from its indices. However, if the operator of the site does not take steps to prevent it, the automatic facilities used to create the indices are likely to find that site and index it again in a relatively short amount of time. 
 

Indemnity 
You agree to defend, indemnify and hold harmless EonFactory, its subsidiaries, affiliates, successors, assigns, officers, directors, employees, agents, and other partners and employees from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees and court costs) arising from: (i) your use of and access to EonSex; (ii) your violation of any term of this Agreement; or (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right.  This defense and indemnification obligation will survive this Agreement and your use of Eonsex. 
 

General 
You agree that: (i) EonFactory shall be deemed solely based in Panama; and (ii) these Terms of Use will be governed by and construed in accordance with the laws of Panama, without giving effect to its conflict of laws provisions or your actual state or country of residence; (iii) EonSex shall be deemed a passive website that does not give rise to personal jurisdiction over EonFactory, either specific or general, in jurisdictions other than Panama.   Any claim or dispute between you and EonFactory that arises in whole or in part from EonSex shall be decided exclusively by a court of competent jurisdiction located in Panama. This Agreement and any other legal notices published on Eonsex, shall constitute the entire agreement between you and EonFactory concerning EonSex.  If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and Eonfactory's failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision. EonFactory reserves the right to amend this Agreement at any time and without notice, and it is your responsibility to review the Agreement for any changes. Your use of EonSex following any amendment of this Agreement will signify your assent to and acceptance of its revised terms.  Any waiver of any provision of the Terms of Use will be effective only if in writing and signed by EonFactory.
